DEFINITIONS

“You” or "User" refers to the user of this website and its related services, and as such “You” have gained the right to use this website by respecting the applicable Terms of Use described in detail below.

"Member" refers to registered user of the website.

Ojas Softech Pvt. Ltd. ("OJAS") is the exclusive owner and operator of AstroSageMarriage.com (the “Site”).

As used in this Terms of Use Agreement, "we" and "us" means AstroSageMarriage.com or any successor, subsidiary, division or assign of AstroSageMarriage.com.

“Service(s)” refers to Your use of the Website for any purpose whatsoever.

OVERVIEW

This Terms of Use Agreement (the "Agreement") sets forth the terms and conditions that apply to Your use of the Website and all services offered by AstroSageMarriage.com. By completing the subscription process You are indicating that You agree to be bound by all of the terms in this Agreement. Please print and keep a copy of this Agreement for Your records. By accessing the Website or using any Services, You consent to receive this Agreement electronically.

We reserve the right to modify this Agreement at any time. Such modified Agreement will become effective and will apply to Your subscription upon our posting such Agreement to the Website. Your continued use of our Service after such a modification has been posted shall be deemed to constitute acceptance by You of any such modified Agreement. It is Your obligation to review the Agreement and to become aware of any modifications.

  1. ELIGIBILITY

    To register as a member of AstroSageMarriage.com or use this Site, you must be of legal marriageable age as per the laws of India (currently, 18 years or over for females and 21 years or over for males). By visiting the Site or accepting these Terms of Use, You represent and warrant to AstroSageMarriage.com that You: (i) are 18 years of age or older, and that You have the right, authority and capacity to agree to and abide by the Agreement and that you are not prohibited or prevented by any applicable law for the time being in force or any order or decree or injunction from any court, tribunal or any such competent authority restraining you from entering into matrimony; (ii) will use the Site in a manner consistent with any and all applicable laws and regulations; and (iii) have not been convicted of any felony and are not required to register as a sex offender with any government authority. If at any time AstroSageMarriage.com is of the opinion (in its sole discretion) or has any reason to believe that you are not eligible to become a member or that you have made any misrepresentation about your eligibility, AstroSageMarriage.com reserves the right to forthwith terminate your membership and / or your right to use the Service at any time.

  1. USER AGREEMENT

    This Agreement constitutes Your agreement with AstroSageMarriage with respect to Your use of the Service. You must abide by all of the terms and conditions of the Agreement in order to become or remain an authorized user of the Service.

  1. RIGHT TO USE

    Your right to use the Service is subject to any limitations, conditions and restrictions established by us from time to time, in our sole discretion. We may alter, suspend or discontinue any aspect of the Service at any time, including the availability of any Service feature, database or content. We may also impose limits on certain features and aspects of the Service or restrict Your access to parts or all of the Service without notice or liability and for any reason.

  1. CODE OF CONDUCT

You agree to use the Service in accordance with the following Code of Conduct:

    1. You will keep all information provided to You through the Service as private and confidential and will not give such information to anyone without the permission of the person who provided it to You.

    2. You will not use the Service to engage in any form of harassment or offensive behavior, including but not limited to the posting of communications, pictures or recordings which contain libelous, slanderous, abusive or defamatory statements, or racist, pornographic, obscene, or otherwise offensive language.

    3. You will not forward chain letters through the Service.

    4. You will not use the Service to infringe the privacy rights, property rights, or any other rights of any person.

    5. You will not post messages, pictures or recordings or use the Service in any way that;

      1. violates, plagiarizes or infringes upon the rights of any third party, including but not limited to any copyright or trade-mark law, privacy or other personal or proprietary rights, or

      2. is fraudulent or otherwise unlawful or violates any law.

    6. You will not use the Service to distribute, promote or otherwise publish any material containing any solicitation for funds, advertising or solicitation for goods or services. Parties responsible for the distribution, promotion or publication of any material containing any solicitation for funds, advertising or solicitation for goods or services agree to pay AstroSageMarriage Fifty Thousand Rupees (INR Rs. 50,000.00) per account involved with such activities to cover expenses involved with investigation and prosecution of such activities.

    7. You will not use the Service to distribute or upload any virus, or malicious software of any type, or do anything else that might cause harm to the Service, the Website, AstroSageMarriage, its systems, or any other members' systems in any way.

    8. You will not post or transmit in any manner any contact information including but not limited to email addresses, "instant messenger" nicknames or contact information, telephone numbers, postal addresses, URLs, and full names through publicly posted information on the Website and through its Services.

    9. You will not cause the Service to be accessed through any automated or robotic means, including but not limited to the rapid access of the site as in a denial-of-service attack. Such restriction shall not apply to legitimate search engine activity that does not place an unreasonable burden on the Service.

    10. You will not use a third-party application such as a mobile smart phone application, social media or other Web page widget, or any other such mobile, social media, Web, or desktop application to access the Service, except where such application is either provided by us or endorsed by us. Such restriction shall not apply to a browser application which merely displays the pages of the Service in their entirety without modification or reformulation of content.

  1. MONITORING OF INFORMATION

    We may use third-party advertising companies, such as Yahoo!, Google, and Microsoft, to serve ads when you visit our website. These companies may use information about your interests in order to provide advertisements about goods and services of interest to you.     We reserve the right to monitor all advertisements, public postings and messages to ensure that they conform to content guidelines that are monitored by us and subject to change from time to time.   1. REMOVAL OF INFORMATION

    We do not and cannot review all profiles, public postings, messages or other materials posted or sent by users of the Service. We are not responsible for any of the content of these profiles, public postings, messages or other materials. We reserve the right, but are not obligated to, delete, move or edit profiles, public postings, messages and other materials that we, in our sole discretion, deem to be in violation of the Code of Conduct as set out above or any other applicable content guidelines or deem to be otherwise unacceptable. You shall remain solely responsible for the content of profiles, public postings, messages and other materials You may upload to the Service.

  1. TERMINATION OF ACCESS TO SERVICE

    We may, in our sole discretion, terminate or suspend Your access to all or part of the Service at any time, with or without notice, for any reason, including, without limitation, breach of this Agreement. Without limiting the generality of the foregoing, any fraudulent, abusive, or otherwise illegal activity that may otherwise affect the enjoyment of the Service or the Internet by others may be grounds for termination of Your access to all or part of the Service at our sole discretion, and You may be referred to appropriate law enforcement agencies.

    You may also terminate your membership at any time, for any reason by writing to AstroSageMarriage.com. In the event you terminate your membership, you will not be entitled to a refund of any unutilized subscription fees, if any, paid by you, except where otherwise stated in writing. Certain provisions of this Agreement including sections 4, of this Agreement shall remain effective even on termination.

  2. PROPRIETARY INFORMATION

    The Service contains information which is proprietary to us, our partners, and our users. We assert full copyright protection in the Service. Information posted by us, our partners or users of the Service may be protected whether or not it is identified as proprietary to us or to them. You agree not to modify, copy or distribute any such information in any manner whatsoever without having first received the express written permission of the owner of such information.

  1. NO RESPONSIBILITY

    You acknowledge that we are not responsible for interruption or suspension of the Service, regardless of the cause of the interruption or suspension.

  1. SECURITY

    You are responsible for maintaining the confidentiality of Your username and password, and You should not allow anyone to use Your password to access any Services. You are responsible for all usage or activity on the Service by users using Your password, including but not limited to use of Your password by any third party. You agree to immediately notify AstroSageMarriage of any unauthorized use of Your username or password or any unauthorized access to Your account. For Your own security, it is advisable to log out when You finish each use of the Services, especially if You are using a public computer or share a computer with others. When logging into the Services using a public computer please use caution to prevent other people from learning Your username and password.

  1. INTERACTIONS WITH OTHER MEMBERS

    YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER MEMBERS. YOU UNDERSTAND THAT ASTROSAGEMARRIAGE CURRENTLY DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON ITS MEMBERS. ASTROSAGEMARRIAGE ALSO DOES NOT INQUIRE INTO THE BACKGROUNDS OF ALL OF ITS MEMBERS OR ATTEMPT TO VERIFY THE STATEMENTS OF ITS MEMBERS. ASTROSAGEMARRIAGE MAKES NO REPRESENTATIONS OR WARRANTIES AS TO THE CONDUCT OF MEMBERS OR THEIR COMPATIBILITY WITH ANY CURRENT OR FUTURE MEMBERS. ASTROSAGEMARRIAGE RESERVES THE RIGHT TO CONDUCT ANY CRIMINAL BACKGROUND CHECK OR OTHER SCREENINGS (SUCH AS SEX OFFENDER REGISTER SEARCHES), AT ANY TIME AND USING AVAILABLE PUBLIC RECORDS.

    IN NO EVENT SHALL ASTROSAGEMARRIAGE BE LIABLE FOR ANY DAMAGES WHATSOEVER, WHETHER DIRECT, INDIRECT, GENERAL, SPECIAL, COMPENSATORY, CONSEQUENTIAL, AND/OR INCIDENTAL, ARISING OUT OF OR RELATING TO THE CONDUCT OF YOU OR ANYONE ELSE IN CONNECTION WITH THE USE OF THE SERVICE, INCLUDING WITHOUT LIMITATION, BODILY INJURY, EMOTIONAL DISTRESS, AND/OR ANY OTHER DAMAGES RESULTING FROM COMMUNICATIONS OR MEETINGS WITH OTHER REGISTERED USERS OF THIS SERVICE OR PERSONS YOU MEET THROUGH THIS SERVICE. YOU AGREE TO TAKE REASONABLE PRECAUTIONS IN ALL INTERACTIONS WITH OTHER MEMBERS OF THE SERVICE, PARTICULARLY IF YOU DECIDE TO MEET OFFLINE OR IN PERSON. YOU UNDERSTAND THAT ASTROSAGEMARRIAGE MAKES NO GUARANTEES, EITHER EXPRESS OR IMPLIED, REGARDING YOUR ULTIMATE COMPATIBILITY WITH INDIVIDUALS YOU MEET THROUGH THE SERVICE. YOU SHOULD NOT PROVIDE YOUR FINANCIAL INFORMATION (FOR EXAMPLE, YOUR CREDIT CARD OR BANK ACCOUNT INFORMATION) TO OTHER MEMBERS.

  1. EXTERNAL LINKS

    The Service may contain links to other Internet sites and resources ("External Links"). You acknowledge that we are not responsible for and have no liability as a result of the availability of External Links or their contents. We suggest that You review the terms of use and privacy statements of such External Links prior to using them.

    You understand that by using any of the External Links, You may encounter content that may be deemed offensive, indecent, or objectionable, which content may or may not be identified as having explicit language, and that the results of any search or entering of a particular URL may automatically and unintentionally generate links or references to objectionable material. Nevertheless, You agree to use the External Links at Your sole risk and that AstroSageMarriage shall not have any liability to You for content that may be found to be offensive, indecent, or objectionable. It shall be Your sole and exclusive obligation to prevent children and other persons from viewing or accessing any inappropriate content that may be included in or available through any External Links.

    By using External Links, You acknowledge and agree that AstroSageMarriage is not responsible for examining or evaluating the content, accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect of such materials at External Links. AstroSageMarriage does not warrant or endorse and does not assume and will not have any liability or responsibility to You or any other person for any External Links or for any other materials, products, or services of third parties.

    AstroSageMarriage shall not be responsible for the contents of, updates to, or privacy practices of third parties operating External Links, which may differ from those of AstroSageMarriage. The personal data You may choose to give to such third parties are not covered by AstroSageMarriage's privacy policies. Some third party companies may choose to share their personal data with AstroSageMarriage, in which case such data sharing shall be governed by that third party's privacy policy.

    You understand and agree that your use of External Links may result in harmful or unwanted content or malicious software infecting or interacting with your computer or mobile device. You accept all risk in connection with such External Links, and you agree that AstroSageMarriage shall have no responsibility to you in the event your computer or mobile device is affected in any way by your use of External Links.

  1. NON-COMMERCIAL USE BY MEMBERS.

    The AstroSageMarriage.com Site is for the personal use of individual members to advertise and promote their profiles for the purpose of generating Accepts from relevant matches and cannot be used in connection with any commercial endeavors. This includes providing links to other web sites, whether deemed competitive to AstroSageMarriage.com or otherwise. Organizations, companies, and/or businesses cannot become Members of AstroSageMarriage.com and should not use the AstroSageMarriage.com Service or Site for any purpose. Illegal and/or unauthorized uses of the Site, including unauthorized framing of or linking to the Site will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal, and injunctive redress.

    The AstroSageMarriage.com Site is for the personal use of individual members to advertise and promote their profiles for the purpose of generating Accepts from relevant matches and cannot be used in connection with any commercial endeavors.   1. OTHER TERMS OF USE BY MEMBERS.

    1. AstroSageMarriage.com reserves the right in it's sole discretion to review the activity & status of each account & block the account of a member based on such review.

    2. You hereby confirm that as on date of this registration, you do not have any objection to receiving emails, messages and calls from AstroSageMarriage.com and members of AstroSageMarriage.com as long as you are a registered member of AstroSageMarriage.com. This consent shall supersede any preferences set by you with or registration done with the Do Not Disturb (DND Register)/ National Customer Preference Register (NCPR). This consent extends to emails, messages or calls relating but not limited to phone number verification, the provision of matrimonial advertising service, matrimonial enquiries and promotions.

    3. Multiple profiles of the same person are not allowed on AstroSageMarriage.com. AstroSageMarriage.com reserves the right to deactivate all multiple profiles without any refund of subscription fees.

    4. Except for the purpose of promoting/advertising your profile for matrimonial purposes, you cannot engage in advertising to, or solicitation of, other Members to buy or sell any products or services through the Service. You will not transmit any chain letters or junk email to other AstroSageMarriage.com Members. Although AstroSageMarriage.com cannot monitor the conduct of its Members off the AstroSageMarriage.com Site, it is also a violation of these rules to use any information obtained from other members in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent.

    5. In order to protect AstroSageMarriage.com and/or our Members from any abuse / misuse, AstroSageMarriage.com reserves the right to take appropriate steps as it deems appropriate in its sole discretion in order to protect interest of other Members.

    6. You cannot use any automated processes, including IRC Bots, EXE's, CGI or any other programs/scripts to view content on or communicate / contact / respond / interact with AstroSageMarriage.com and/or its members.

    7. AstroSageMarriage.com reserves the right to screen communications/advertisements that you may send to other Member(s) and also regulate the same by deleting unwarranted/obscene communications/advertisements at any time at its sole discretion without prior notice to any Member.

  1. PROPRIETARY RIGHTS IN THE CONTENT ON ASTROSAGEMARRIAGE.COM

AstroSageMarriage.com owns and retains all proprietary rights in the AstroSageMarriage.com Site and the AstroSageMarriage.com Service. The Site contains the copyrighted material, trademarks, and other proprietary information of AstroSageMarriage.com, and its licensors. Except for that information which is in the public domain such as member profile or for which permission has been obtained from the user, you cannot copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information. Any such act or an attempted act on your part shall constitute a violation of this Agreement and your membership is liable to be terminated forthwith by AstroSageMarriage.com without refund of any of your unused Subscription fees. We also reserve our right to take legal action (civil and/or criminal) wherever applicable for any violations.

  1. CONTENT POSTED ON THE SITE

    1. You understand and agree that AstroSageMarriage.com may delete any listing, content, communication, photos or profiles (collectively, "Content") that in the sole judgment of AstroSageMarriage.com violate this Agreement or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of either AstroSageMarriage.com and/or its Members.

    2. With respect to Content you submit or make available for inclusion on publicly accessible areas of the Site including but not limited to your contact details, you hereby unconditionally and irrevocably grant to AstroSageMarriage.com the license to use, distribute, reproduce, modify, adapt, publicly perform and publicly display such Content on the Site and related concerns from time to time.

    3. You shall use the Services only to market and promote your profile and to reach out to other Members for the purpose of driving an ‘Accept’ from relevant matches. You understand and hereby agree that all information, data, text, photographs, graphics, communications, tags, or other Content whether publicly posted or privately transmitted or otherwise made available to AstroSageMarriage.com, are the sole responsibility of the person from whom such Content originated and shall be at the member's/person's sole risks and consequences. This means that you (and not AstroSageMarriage.com) are solely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service. AstroSageMarriage.com does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. Under no circumstances will AstroSageMarriage.com be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service. AstroSageMarriage.com reserves the right to verify the authenticity of Content posted on the Site. In exercising this right, AstroSageMarriage.com may ask you to provide any documentary or other form of evidence supporting the Content you post on the Site. If you fail to produce such evidence, AstroSageMarriage.com may, in its sole discretion, terminate your Membership without a refund.

    4. By posting Content/ advertising to any public area of AstroSageMarriage.com, you automatically grant, and you represent and warrant that you have the right to grant, to AstroSageMarriage.com, and other AstroSageMarriage.com Members, an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, copy, perform, display, and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing.

    5. The following is an indicative list of the kind of Content that is illegal or prohibited on the Site. AstroSageMarriage.com will investigate and take appropriate legal action in its sole discretion against anyone who violates this Agreement, including without limitation, removing the offending communication / Content from the Service and terminating the Membership of such violators without a refund.

      Illegal and prohibitive Content includes Content which:

      1. is blatantly offensive to the community, such as Content that promotes racism, bigotry , hatred or physical harm of any kind against any group or individual;

      2. harasses or advocates harassment of another person;

      3. involves the transmission of "junk mail", "chain letters," or unsolicited mass mailing or "spamming";promotes information that you know is false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;

      4. promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page) ;

      5. displays pornographic or sexually explicit material of any kind;

      6. provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18;

      7. provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;

      8. solicits passwords or personal identifying information for commercial or unlawful purposes from other users; and

      9. engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes.

  1. COPYRIGHT POLICY

You cannot post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights. Without limiting the foregoing, if you believe that your work has been copied and posted on the AstroSageMarriage.com service in a way that constitutes copyright infringement, please provide us with the following information:

    1. an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;

    2. a description of the copyrighted work that you claim has been infringed;

    3. a description of where the material that you claim is infringing is located on the our Site;

    4. your address, telephone number, and email address;

    5. a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;

    6. a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Notice of claims of copyright infringement can be sent to us in writing to the Agra address located under the Help/Contact section on the site.

  1. MEMBER DISPUTES

    You are solely responsible for your advertisement/communications with other AstroSageMarriage.com Members. AstroSageMarriage.com reserves the right, but has no obligation, to monitor disputes between you and other Members. AstroSageMarriage.com also reserves the right to take appropriate action against errant members. However, AstroSageMarriage.com is not obliged to share such action with other members, including complainants. AstroSageMarriage.com expressly disclaims any responsibility or liability for any transactions or interactions between the members inter-se.

  1. DISCLAIMERS

    1. AstroSageMarriage.com is not responsible for any incorrect or inaccurate Content/listing posted on the Site or in connection with the AstroSageMarriage.com Service, whether caused by Users, Members or by any of the equipment or programming associated with or utilized in the Service, nor for the conduct of any User and/or Member of the AstroSageMarriage.com Service whether online or offline.

    2. AstroSageMarriage.com assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, User and/or Member communications or any communications by AstroSageMarriage.com to its Members.

    3. AstroSageMarriage.com is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any web site or combination thereof, including injury or damage to Users and/or Members or to any other person's computer related to or resulting and/or in connection with the AstroSageMarriage.com Service.

    4. Under no circumstances will AstroSageMarriage.com be responsible for any loss or damage resulting from anyone's use of the Site or the Service and/or any Content posted on the AstroSageMarriage.com Site or transmitted to AstroSageMarriage.com Members.

    5. The exchange of matrimonial profile(s) through or by "AstroSageMarriage.com" is not a matrimonial offer and/or recommendation from/by AstroSageMarriage.com. AstroSageMarriage.com shall not be responsible for any loss or damage to any individual arising out of, or subsequent to, any relations (including but not limited to matrimonial relations) established pursuant to the use of AstroSageMarriage.com.

    6. The Site and the Service are provided "AS-IS" and AstroSageMarriage.com expressly disclaims any warranty of fitness for a particular purpose or non-infringement. AstroSageMarriage.com cannot guarantee and does not promise any specific results from use of the Site and/or the AstroSageMarriage.com Service.

    7. AstroSageMarriage.com expressly disclaims any liability or responsibility whatsoever and howsoever arising as a result of any Content/listing posted on the Site / made available to AstroSageMarriage.com by any Members or the users of the Site or any third party.

    8. AstroSageMarriage.com does not assume any responsibility or liability for any illegal Content posted on the Site by any Members, users or any third party.

    9. All liability, whether civil or criminal arising out of any Content that is Posted on the Site will be of that Member / user / third party who has Posted such Content and AstroSageMarriage.com reserves its right to claim damages from such Member/ user / third party that it may suffer as a result of such Content Posted on the Site. AstroSageMarriage.com does not claim ownership of Content you submit or make available for inclusion on the Service.

  1. LIMITATION ON LIABILITY

In no event will AstroSageMarriage.com be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from your use of the Site or the AstroSageMarriage.com Service, even if AstroSageMarriage.com has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, AstroSageMarriage.com's liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to AstroSageMarriage.com, for the Service during the term of membership.

  1. JURISDICTION
